This Privacy Policy describes how pluckphoto, inc. (“pluckphoto, we or us”) collects, uses, and discloses information obtained through your use of the pluckphoto mobile application or any other the software applications made available by us for use on or through computers and mobile devices (the “App”), websites operated by us from which you may be accessing this Privacy Policy (the “Site”), as well as through email messages that we send to you that link to this Privacy Policy (collectively, the App, Site and other services provided by us, the “Service”). By downloading the App and using the Service, you acknowledge that you understand and agree to this Privacy Policy. This Privacy Policy was last updated March 14, 2017.

Personal information we may collect

“Personal Information” is information that identifies you as an individual or relates to an identifiable person. We may collect Personal Information including:

postal address (including billing and shipping addresses)

personally identifying information that may appear in any photos submitted to the Service

We collect Personal Information through the Service. For example, when registering an account to use the Service you will be required to submit your name, email address, mailing address and other information we request. Additionally, by using the App you submit photos from your mobile devices photo gallery to the Service, which may include Personal Information.

We may also receive your Personal Information from other sources, such as public databases; joint marketing partners; social media platforms; from people with whom you are friends or otherwise connected on social media platforms, as well as from other third parties. For example, if you elect to connect your social media account to your account (if such feature is made part of the Service), certain Personal Information from your social media account will be shared with us, which may include Personal Information that is part of your profile or your friends’ profiles on that social media service (or another linked service).

We may use a third-party payment service to process any payments made through the Service. If you wish to make a payment through the Service, your Personal Information may be collected by the third party, and not by us, and will be subject to such third party’s privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, such third party’s collection, use, and disclosure of your Personal Information.

How we may use personal information

We and our service providers may use Personal Information:

• To respond to your inquiries and fulfill your requests for products or services (including sending you photos, either automatically or as purchased by you).
To send administrative information to you, for example, information regarding the Service and changes to our terms, conditions, and policies.
To complete and fulfill your purchases, for example, to process your payments, have your order delivered to you, communicate with you regarding your purchases and provide you with related customer service.

For our business purposes, such as data analysis, audits, fraud monitoring and prevention, developing new products, enhancing, improving or modifying our Service, identifying usage trends, determining the effectiveness of our promotional campaigns and operating and expanding our business activities.

To our third-party service providers who provide services such as photo processing and printing, website hosting, data analysis, payment processing, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, credit card processing, auditing and other similar services.
To advertising partners in order to select advertising and marketing material we believe may be of interest to you, provided your Personal Information is never sold to advertisers.
To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).

We also may use and disclose Personal Information as we believe to be necessary or appropriate: (a) under applicable law, which may include laws outside your country of residence; (b) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (c) to enforce our Terms of Service; (d) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (e) to allow us to pursue available remedies or limit the damages that we may sustain.

The Service does require accessing your photo gallery or library on your phone, however, other than photos selected for printing and mailing to you, we do not give access to your photo gallery or library to any third party.

“Other information” is any information that does not reveal your specific identity or does not directly relate to an identifiable individual, such as:

Browser and device information
App usage data
Information collected through cookies, pixel tags and other technologies
Demographic information and other information provided by you
Aggregated information

How we may collect other information

We and our third-party service providers may collect Other Information in a variety of ways, including through your IP Address, mobile device, or browser, or through the use of technologies such as cookies, beacons, tags, and scripts. These technologies may be used by us or our advertising partners and affiliates to analyze trends, administer the Service, track users’ engagement with the Service, and gather demographic information about our user base. We may also receive reports based on the use of these technologies by third parties on an individual or aggregated basis in order to better provide you with advertisements that we believe may be relevant to your interests. Aggregated Personal Information does not personally identify you or any other user of the Service. For example, we may aggregate Personal Information to calculate the percentage of our users in any geographic area.

Google Analytics or other Google services

We may use various features of Google Analytics Advertising, which may include Remarketing, Google Display Network Impression Reporting, Google Analytics Demographics and Interest Reporting, and Integrated services that require Google Analytics to collect data via advertising cookies and identifiers.

Please note that we may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. If we are required to treat Other Information as Personal Information under applicable law, then we may use it for all the purposes for which we use and disclose Personal Information. In some instances, we may combine Other Information with Personal Information (such as combining your name with your geographical location). If we combine any Other Information with Personal Information, the combined information will be treated by us as Personal Information as long as it is combined.

Third-party services

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including that of any advertising partner or website linked to within the Service.

We seek to use reasonable organizational, technical and administrative measures to protect Personal Information from unauthorized access. We use third-party service providers capable of protecting the information they maintain or process for us. Unfortunately, no data transmission or storage system is 100% secure. We may from time to time give you choices regarding our use and disclosure of your Personal Information for marketing purposes. However, the use and disclosure of your Personal Information as outlined in this Privacy Policy is required in order for us to provide you with certain features of the Service.

You can also stop receiving promotional email communications from us by clicking on the “unsubscribe” link provided in each such communication. Please note that if you do opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, and you cannot opt-out from receiving administrative messages.

Retention Period

We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

Use of service by minors

The Service is not directed to individuals under the age of thirteen (13), and we request that these individuals do not provide Personal Information through the Service.

Updates to the privacy policy

This Privacy Policy may be updated from time to time to reflect changes to information practices. If any material changes to the Privacy Policy are made, we will provide notice to registered users of the Service by email (sent to the email address provided to us), by notification through the App, and/or by posting the revised Privacy Policy to the Site prior to the change becoming effective.
